27-year old Faiya Musa, a physically challenged man has been sentenced to seven years imprisonment following his conviction of the offence of sexual penetration of a minor.
Delivering his judgement on Wednesday 10th February 2021 at the High Court in Freetown, Justice John Bosco Allieu said that the Prosecution had proven its case beyond all reasonable doubt.
He noted that the accused made a confessional statement to the police and pleaded that the matter not be charged to court but later denied knowing the victim at the commencement of the trial.
The persecution led-in evidence five witnesses including the 15 year-old victim, her sister and the investigating officer.
The victim in her testimony told the court that the accused met her on the street and said he was in love with her and later took her to an unfinished building where she was abused multiple times and then given the sum of Le5, 000.
In her plea mitigation, Legal Aid lawyer Cecilia Tucker implored the judge to temper justice with mercy amidst the seriousness of the offence committed. She added that the convict was young and resourceful and therefore should not be allowed to waste in prison.
The term of imprisonment includes the time already spent in prison.
The prosecution had alleged that the accused on the 20th June 2018 in the Western Area of Freetown, involved in an act of sexual penetration with a child below the age of 18.
