The Resident High Court Judge in Kailahun District, Justice Francis Banks-Kamara, has discharged Musa Fayia who had earlier been convicted by a Magistrate court and was serving a four-year prison sentence.
After spending over two years at the Kailahun Correctional Centre, Fayia benefited from the nationwide judicial review of cases and was set free.
Explaining his ordeal to the Judge at the last Judicial Week that saw judges holding court within prisons across the country, Fayia said: "I was brought to court by the Section Chief who reported that I stole my mother's pepper in her garden without her consent and when I eventually appeared before Magistrate Musa Fayia, he sentenced me to four years even against the passionate plea of my mother."
Fayia further stated: "My mother told the Magistrate that she wasn't ready to continue with the matter but the Magistrate insisted that the matter will continue."
Also, five inmates appeared before Banks Kamara without case files and the evidence brought against them cannot be substantiated. They were all summarily discharged by the judge.
