Sierra Leone main opposition to challenge new injunction

Lawyers representing the main opposition All Peoples Congress (APC) Party have said that they have entered an appearance to challenge the recent court injunction slammed on the party.

Lawyer Addy Macualey told Politico that the party’s legal team would file a motion before the court to strike out the action on the basis of what he referred to as “strange irregularities.”

He said that the litigants have embarked on an abuse of process by using the court as a playground to settle political scores. “It’s an abuse of process which the litigants have embarked on, on the basis that immediately one of the cases they brought to court is thrown out, another litigants with a different name will start on the same issue and the sooner the court comes to realize that they’re using it as a playground to settle political scores the better.”

He added that what the Plaintiff Applicants are doing is using the court as a political instrument to effect whatever change they’re seeking which he said cannot be achieved until the necessary steps which do not include a court action are taken.

He stressed that: “our concern as lawyers is that we should not use the court as a political instrument to settle political scores, it will be a grave injustice.”

Lawyer Macauley said that unless the court renews the injunction, by Friday there will be no substantive injunction against the party because of the manner in which the action was brought before the court.

The recent action brought up against the party by way of an Ex-Parte notice of motion supported by an affidavit sworn to by Rashid Santigie Sesay comes just a day after a similar action was dismissed by Justice Komba Kamanda.
