The Centre for Accountability and Rule of Law (CARL) has reacted to the Supreme Court ruling on the Proportional Representation System.
In a statement issued on 31 January 2023 in the case that was brought by two members of the opposition All People’s Congress (APC), CARL cited complaints and arguments that the PR system ‘’undermines democracy because it vests excessive power in political parties and deprives independent candidates from participating in the process”.
CARL commended the decision of the Supreme Court and for pointing out that as long as it is a matter of public interest, a plaintiff need not show that they are directly affected by an issue or action. The organization said the ruling was a major step in ensuring that they promote human rights and equity.
The court was commended for looking into the complaint as quickly and in a very transparent manner as compared to previous cases which CARL said took a while to be resolved.
The press statement from CARL ended by saying that the decision which was taken was based on substance or merit on the complaints, and relevant because some election related cases filed with the Supreme Court since 2012 were resolved or dismissed on technical grounds rather than on their merits.
